12. Tender of compensation
At any time previous to an arbitration the Authority may by notice served upon the owner, lessee or other occupier tender to such owner, lessee or other occupier a sum by way of compensation, and if on arbitration the amount of the award is not greater than the sum so tendered, the costs of such arbitration shall be borne by the owner, lessee or other occupier, but in any other case the said costs shall be payable as regards public highways and public by-ways out of the general revenue of the State.
