11.   Duties of the magistrate when making award

The magistrate shall before making his or her award estimate the advantage as well as disadvantage, if any, accruing to the adjacent land from the widening or alteration of the course of any road, and if in his or her opinion the value of such advantage exceeds the value of the land encroached upon or more than compensates for the material taken or the damage suffered by the owner or occupier of the adjacent land, the compensation shall be nominal.
