10.   Width of roads

  1.  

    (1)   The maximum width to which a public highway may be repaired and kept in repair shall be 30 feet and a public by-way 16 feet, exclusive of ditches and side drains. However, compensation shall be payable in accordance with the next subsection to the owner lessee or occupier for the value of any soil encroached over 24 feet and 16 feet respectively with allowances being made for ditches and side drains.

    (2)   Where for any special reason any road or part thereof shall require to be widened beyond the limits specified in the last preceding subsection or the course of a road shall require to be altered, the same shall be widened or altered in such manner as the Authority shall direct, and there shall be payable to the owner for the value of the soil encroached on for the purpose of such widening or alteration, as well as to the lessee or other occupier of such soil for the value of any crop standing thereon at the time, such compensation as shall be agreed upon between the Authority and the owner or lessee or other occupier as aforesaid; and in case of difference between the Authority and such owner or lessee or other occupier with regard to such compensation, either party may give to the other 7 days' notice in writing of his or her intention to refer the matter to the magistrate within whose district the land is situate, who shall hear, settle and determine the amount of such compensation, and the costs attending the hearing and determining the same. The award of such magistrate shall be final.
