8.   Offence - unauthorised publication or disclosure

  1.  

    (1)   A member or any other person shall not without the written permission of the chairperson publish or disclose to any person or otherwise than in the course of duty the contents or any part of the contents of any document, communication or information whatsoever which has come to his or her knowledge in the course of his or her duty in respect of any matters referred to the Commission, or dealt with by an officer to whom the Commission has delegated authority, and any person who knowingly acts in contravention of the provisions of this section commits an offence and is liable on summary conviction to imprisonment for a term not exceeding one year or to a fine not exceeding $1,000 or to both such imprisonment and fine.

    (2)   If a person who has possession of any information which to his or her knowledge has been disclosed in contravention of the provisions of this section publishes or communicates to any other person otherwise than for the purpose of any prosecution under this Act any such information, he or she commits an offence and is liable on summary conviction to imprisonment for a term not exceeding one year or to a fine not exceeding $1,000 or to both such imprisonment and fine.
