(1) If no recommendation is made by the Board within the period specified in section 39(5) or if no notification is given by the Minister to the applicant within the 14 day period specified in section 40(1), the applicant shall have the right to make a case before the Board or the Minister as the case may be and the Board or the Minister shall hear the case within 7 days of an application for the hearing being made.
(2) An application for a hearing before the Board or the Minister shall be in the prescribed form.
(3) Where, after a hearing pursuant to subsection (2) —
(a) the application is refused by the Minister; or
(b) the Board fails to make a recommendation or the Minister fails to give a notice of a grant within 14 days of the hearing,
the applicant shall have the right of appeal in accordance with section 54.
