If the tester nominated as aforesaid certifies that such samples do consist of volatile petroleum, the petroleum from which such samples have been taken is considered to all intents and purposes as volatile petroleum within the meaning of this Act and the fees of the testers shall be paid into the Treasury by the person demanding the fresh test or may be recovered from him or her on the complaint of the Director of Finance and Planning or any person authorised by him or her in writing in that behalf before a magistrate in the same manner as servants' wages.
