3.   Membership of Non-Governmental Organizations

  1.  

    (1)   Subject to subsection (2), any person eligible for membership in a Non-Governmental Organization under its founding document has the right to remain a member as long as he or she complies with the rules of the Non-Governmental Organization.

    (2)   Notwithstanding subsection (1), a person shall not be a member of a Non-Governmental Organization if that person—

    1.  

      (a)     is at the time of desiring to be a member declared by a court to be—

      1.  

        (i)     a bankrupt,

      1.  

        (ii)     mentally incapacitated by reason of unsoundness of mind; or

    1.  

      (b)     has been convicted of an offence involving dishonesty or an offence under this Act provided that the offence has not been spent according to the Criminal Records (Rehabilitation of Offenders) Act.
