5.   Prohibition

  1.  

    (1)   Subject to subsection (2) and despite any law in force in Saint Lucia to the contrary, except in accordance with an authorization under section 4, a person shall not, in an area declared to be a regulated airspace under this Act, fly, or cause or authorize the flying of, an aircraft.

    (2)   Subsection (1) applies whether or not, for the purposes of flying, the aircraft is attached to land or attached to a thing affixed to land.

    (3)   A person who contravenes subsection (1) commits an offence and upon summary conviction is liable to a fine not exceeding $150,000 or to imprisonment for a term not exceeding 5 years.
