35.   Prohibition on advertising likely to mislead

  1.  

    (1)   A regulated entity shall not engage in advertising practices which are likely to mislead the public concerning—

    1.  

      (a)     the relation of the regulated entity to the Authority or any department or official of the Authority;

    1.  

      (b)     the financial condition of the regulated entity; or

    1.  

      (c)     any other matter relating to the regulated entity.

    (2)   A regulated entity that contravenes subsection (1) commits an offence and is liable on summary conviction to a fine not exceeding $50,000 or to imprisonment for a term not exceeding 3 years or to both.
