COCONUT INDUSTRY FUND REGULATIONS – SECTION 9

Commencement [7 April 1951]

1.   Citation

These Regulations may be cited as the Coconut Industry Fund Regulations.

2.   Interpretation

In these Regulations unless the context otherwise requires the following expressions have the meanings respectively assigned to them, that is to say—

Act” means the Coconut Industry Fund Act;

Committee” means the Committee appointed by the Governor General in accordance with the provisions of section 8(b) of the Act;

fund” has the same meaning as is assigned to it in section 3(1) of the Act;

head A” and “head B” denote the sub-divisions of the fund referred to in section 3(2)(a) and 3(2)(b) respectively of the Act.

Head A

3.   Disbursements from Head A of the Fund

  1.  

    (1)   Disbursements from Head A of the Fund shall be made by the Accountant General on the warrant of the Secretary and the chairperson of the Board of Directors of the Saint Lucia Coconut Growers Association.

    (2)   Disbursements shall be authorised by a resolution of the Board of Directors of the Saint Lucia Coconut Growers Association for any purpose which tends to stabilise the coconut industry of Saint Lucia and a copy of such resolution properly authenticated and setting out the purpose for which any disbursement is to be made shall be submitted to the Accountant General with the warrant for such disbursement from Head A of the Fund.

4.   Books and Records

  1.  

    (1)   The Accountant General shall cause to be kept proper books and records of account in relation to disbursements from Head A of the Fund.

    (2)   The Saint Lucia Coconut Growers Association shall submit to the Accountant General at the close of each financial year of the Association a financial statement duly audited showing the manner in which disbursements from Head A of the fund have been utilised.

Head B

5.   Disbursements from Head B of the Fund

  1.  

    (1)   Disbursements from Head B of the Fund shall be made by the Accountant General on the recommendations of the Committee.

    (2)   Disbursements shall be authorised by a resolution of the Committee for

      (a)     Assisting production and processing;

    1.  

      (b)     Disease control;

    1.  

      (c)     Relief in the event of disaster; and

    1.  

      (d)     Other cases.

    A copy of such resolution authenticated by the signature of the chairperson and one other member not being a public officer and setting out the purpose for which any disbursement is to be made shall be submitted to the Accountant General with the Warrant for such disbursement from Head B of the Fund.

    (3)   In the event it becomes necessary for an exporter not being a member of the Coconut Growers Association to purchase from the Coconut Growers Association copra at a price calculated to include the excess under Head “A” of the Fund and on exportation pay to the Accountant General the prescribed amounts under Head “B” of the Fund, it shall be lawful for the Committee to refund the amount paid to satisfy Head “A” and further this shall be a first charge against Head “B” of the Fund. It shall also be required to refund any amount already paid in excess under the circumstances already described.

6.   Control by Committee of expenditure of disbursements

  1.  

    (1)   The Committee shall take such measures as may be required to ensure that the monies disbursed under regulation 5 are expended for the purposes for which they are intended.

    (2)   Where necessary the Committee shall have the right to expend from Head “B” of the Fund such amounts as may be required for carrying out the provisions of subregulation (1).

7.   Books and Records

  1.  

    (1)   The Accountant General shall cause to be kept proper books and records of account in relation to disbursements from Head “B” of the Fund.

    (2)   The Accountant General shall submit to the Committee at the close of each financial year a financial statement duly audited.
