20.   Onus of proof on defendant

In any proceedings under the preceding section—

  1.  

    (a)     the defendant shall be acquitted if he or she proves to the satisfaction of the court that the animal was slaughtered in obedience of lawful authority, with the permission of a designated officer, or from a humanitarian motive such as the prevention of suffering or any other cause;

    (b)     the onus of proving that the animal was not known, or did not appear to be in calf, in lamb, in kid, or in pig, as the case may be shall be on the defendant.
