3.   Designation of any public officer as a Customs Officer

  1.  

    (1)   Despite any other law, if for any reason there is no customs officer available to perform the functions of a customs officer in relation to a ship arriving at Cul-de-Sac Harbour for the purpose of loading or discharging crude oil or petroleum products at the said harbour then, in any such case, it is lawful for the Comptroller of Customs and Excise to designate any other public officer to perform such functions for so long only as a customs officer is not available for their performance.

    (2)   A public officer so designated has all the rights, powers and duties of a customs officer under the Customs (Control and Management) Act and shall receive such allowances in respect of the performance of the said functions as the Cabinet may approve.
