(1) The Magistrate shall, on committing any person to custody under section 8, inform that person in ordinary language of his or her right to make an application to the High Court for habeas corpus and shall give immediate notice of the committal to the Attorney General.
(2) A person committed to custody under section 8 shall not be returned to a requesting country if an application for habeas corpus is made in his or her case, so long as proceedings in that application are pending.
