3.   Powers of Governor General

  1.  

    (1)   The Governor General may by order—

    1.  

      (a)     fix the quota which may be—

      1.  

        (i)     manufactured,

      1.  

        (ii)     exported,

      1.  

        (iii)     sold or delivered for consumption within Saint Lucia, or

      1.  

        (iv)     held in stock for disposal in addition to (ii) and (iii) during any quota period specified in any such order, and prescribe the conditions under which it shall be granted and under which any such quota shall be disposed of;

      (b)     allocate the quota fixed amongst the manufacturers for each factory and at any time vary and adjust such allocation;

    1.  

      (c)     prescribe the conditions as to the manner of export of any sugar;

    1.  

      (d)     regulate the sale of and price at which any person shall sell or cause to be sold sugar manufactured in Saint Lucia and intended for local consumption either by wholesale or retail;

    1.  

      (e)     define the meaning of “wholesale” and “retail” as applied to the sale or offer for sale of sugar manufactured in Saint Lucia and required or intended for local consumption;

    1.  

      (f)     regulate or provide for such other matters concerning the manufacture, export, sale and disposal of sugar as may be necessary for the carrying out of the purposes and provisions of this Act.

    (2)   If there shall be any contravention of any of the provisions of an order made under the preceding subsection the owner and the manufacturer of the sugar, the subject matter of the contravention, and every other person who is party to the contravention is liable on summary conviction for each offence to a penalty not exceeding $96 and in addition to a further penalty not exceeding $2.40 in respect of each hundred weight of sugar manufactured, exported, sold, delivered or otherwise disposed of, or in respect of each hundred weight of sugar in respect of which there has been failure to manufacture, export, sell, deliver, hold or otherwise dispose of, in contravention of the order.

However, such owner such manufacturer or such other person who is party to the said contravention, is not liable to conviction under the provisions of this section if he or she proves to the satisfaction of the magistrate that the contravention thereof was neither wilful nor due to negligence.
