10.   Major offences

  1.  

    (1)   Any person being a person employed in the execution of any duty under this Act, who—

    1.  

      (a)     by virtue of such employment becomes possessed of any information which might exert an influence upon or affect the market value of any share, interest, product or article and before such information is made public in accordance with the provisions of this Act, directly or indirectly uses such information for personal gain;

      (b)     without lawful authority publishes or communicates to any person otherwise than in the ordinary course of such employment any information acquired by him or her in the course of his or her employment;

      (c)     knowingly compiles for issue any false statistics or information,

  1.  

    commits a misdemeanour and is liable on conviction to imprisonment for a term not exceeding 2 years or to a fine not exceeding $500 or to both such imprisonment and fine.

    (2)   Any person, being in possession of any information which to his or her knowledge has been disclosed in contravention of this Act, who publishes or communicates such information to any person commits a misdemeanour and is liable on conviction thereof to imprisonment for a term not exceeding 2 years or to a fine not exceeding $500 or to both such imprisonment and fine.
