(1) The Minister may, in writing, appoint a person to be an alternate member for any member of the Commission, other than the Chairperson, and the alternate member so appointed may act as a member of the Commission in the event of the absence, incapacity or ineligibility to conduct a hearing of that member.
(2) In the exercise of the power under subsection (1), the Minister shall consult the Chief Justice or the Commissioner as the case may be, where an alternate is to be appointed to act for a member nominated by the Chief Justice or the Commissioner.
