(1) Where the complainant does not attend the hearing, having had due notice of the time and place of hearing, the Commission may dismiss the complaint, unless having received a reasonable excuse for the non-appearance of the complainant the Commission thinks it fit to adjourn the matter.
(2) Any other person who—
(a) refuses or neglects without reasonable cause, to attend a hearing in compliance with the requirements of a notice issued under section 33; or
(b) departs from a hearing without the authority of the person holding the hearing,
commits an offence and is liable on summary conviction to a fine of $1,000 and to imprisonment for one year.
