3.   Pensions Regulations

  1.  

    (1)   Subject to such modifications as are contained in sections 3 and 4 or may be made by regulations under section 5, the provisions of the principal Act shall apply to all persons employed in the Public Service eligible for a pension or other benefit and shall include persons employed in—

    1.  

      (a)     the Teaching Service;

    1.  

      (b)     the Prisons Service;

    1.  

      (c)     the Royal Saint Lucia Police Force; and

    1.  

      (d)     the Saint Lucia Fire Service.

    (2)   For the avoidance of doubt it is hereby declared that the provisions of this Act shall not have retrospective effect but shall be applied only in respect of persons who as from the date of commencement of this Act are eligible for a pension or other benefit.

    (3)   Pensions, gratuities and other allowances may be granted by the Governor General in accordance with the regulations contained in the Schedule to this Act to or in respect of officers who have been in public service under the Government of Saint Lucia.

    (4)   The Governor General may make regulations amending, adding to or revoking the regulations contained in Schedule 1, and all regulations so made shall be laid before the House of Assembly and published in the Gazette.

    (5)   Whenever the Governor General is satisfied that it is equitable that any regulation made under this section should have retrospective effect in order to confer a benefit upon or remove a disability attaching to any person, that regulation may be given retrospective effect for that purpose.

    However, no such regulation shall have retrospective effect unless it has received, before being made, the approval of the House of Assembly signified by resolution.

    (6)   All regulations made under this Act have the same force and effect as if they were contained in Schedule 1 and the expression “this Act” shall, wherever it occurs in this Act, be construed as including a reference to the said Schedule.

    (7)   Any pension, gratuity or other allowance granted under this Act shall be computed in accordance with the provision in force or, having been made in accordance with subsection (3), may be deemed to be in force at the actual date of an officer's retirement or death while in the public service, as the case may be.
