27.   Prohibition on selling

  1.  

    (1)   A person shall not—

    1.  

      (a)     sell or offer for sale goods or services on a beach or in a protected area without obtaining a licence under this Act;

    1.  

      (b)     contravene a condition contained in a licence issued under this Act;

    1.  

      (c)     fail to display a licence in accordance with section 21;

    1.  

      (d)     fail, without reasonable excuse, to comply with a request made under section 22; or

    1.  

      (e)     for the purpose of selling goods or services or any unlawful purpose, solicit in a protected area.

    (2)   Where a licence is suspended or cancelled under section 23, the person to whom it was granted shall not, pending the determination of an appeal against suspension or cancellation, carry on the business in respect of which the licence was granted.

    (3)   A person who contravenes subsection (1) or (2) commits an offence and upon summary conviction is liable to a fine of $1,000 or to imprisonment for a term of 3 months, or to both.
