35.   Power to apprehend person giving false name or address

  1.  

    (1)   Any peace officer, or other person authorised in writing by a magistrate may demand the name and address of any person found on the premises during the period in which they are required by law to be closed; and if he or she has reasonable grounds to suppose that the name or address given is false may require evidence of the correctness of the name or address, and may, if the person fails upon his or her demand to give his or her name or address, or the required evidence, apprehend him or her without a warrant.

    (2)   If any person required under this section to give his or her name and address fails to give the same, or gives a false name or address, or gives false evidence with respect to his or her name and address, he or she commits an offence.
