17.   Award of Board

  1.  

    (1)   At the conclusion of the inquiry the Board shall decide upon the claims for compensation and apportionments submitted to them and shall make an award under the hand of the chairperson who shall cause the same to be filed in the High Court.

    (2)   The decision of the majority of the members of the Board with respect to the compensation to be paid is considered to be the decision of the Board, and, if all the members of the Board differ, the mean between the amount decided upon by the chairperson and that one of the amounts decided upon by the 2 other members of the Board which approximates most nearly to the amount decided upon by the chairperson is considered to be the compensation awarded by the Board.

    (3)   An appeal shall lie against the decision of the Board and for the purposes of such appeal the decision of the Board shall be deemed to be a final judgment or decision of a judge of the High Court sitting as a court of first instance.
