9.   Prohibition of distilling, etc., without licence

  1.  

    (1)   A person shall not, without being licensed to do so or on any premises to which his or her licence does not extend, use any distillery apparatus or make wash or distil low-wines or spirits or have in his or her possession any wash or low-wines.

    (2)   Any person who contravenes this section shall incur a penalty not exceeding $2,500 and in default of payment thereof shall be imprisoned, with or without hard labour, for a term not exceeding 12 months, and all spirits and vessels, utensils and materials for distilling or preparing spirits in his or her possession shall be forfeited.
