(1) In any complaint or proceeding against any person under this Act it shall not be necessary to negative any exemption, exception or proviso in his or her favour, but the onus of proving the applicability of such exemption, exception or proviso shall lie on him or her.
(2) In any proceeding relating to spirits under this Act the onus of proving that the full duties chargeable on the spirits were paid shall lie on the defendant.
