67.   Persons in possession of unpermitted spirits

    (1)   It is lawful for any justice of the peace, officer or police officer having reason to suspect that a person is carrying or has in his or her possession spirits illicitly distilled or brought into the State, on which duty has not been paid, to stop and detain such person and require him or her to produce a permit for the removal of such spirits or otherwise account for his or her possession of the same.

    (2)   Every person in unlawful possession of spirits shall, in addition to any other penalty to which he or she may be liable, incur a penalty not exceeding $1,000, and may be detained by any officer or police officer and brought before a magistrate to be dealt with. (Amended by Act 2 of 1992)
