12.   Special licence may be granted to chemists and others

  1.  

    (1)   A licence to use a still subject to prescribed conditions may, at the discretion and by the direction of Cabinet, be granted to any chemist or druggist for the preparation of medicines or articles used for medicinal purposes, and to any person for purification of water or for purposes of scientific research or for distilling essences or essential oils; for every such licence there shall be paid to the Accountant General the sum of $2.40.

    However, Cabinet, if satisfied that the capacity of the still does not exceed 3 litres, may grant exemption from such payment.

    (2)   Cabinet may at any time revoke any such licence.

    (3)   Every application for a licence, by way of renewal or otherwise, to be granted under this section shall be made by the owner in writing to Cabinet, and shall state the place or premises where the still is to be kept, the purpose or purposes for which it is to be used, and the full capacity of the still.

    (4)   Every holder of a licence under this section who fails to comply with any of the conditions prescribed in respect of his or her still shall incur a penalty not exceeding $1,000. (Amended by Act 2 of 1992)

    (5)   Every person who holds a licence granted under this section is exempt from the provisions of Schedule 1 and of sections 13, 20, 22 to 27 inclusive, 55 and 56 hereof, except in so far as the same or any of them shall be comprised in the conditions prescribed.

    (6)   A licence may also be granted by Cabinet to any chemist or druggist or any manufacturer of bay rum or perfumed spirits prescribing the conditions subject to which any spirits made within the State may be used in pharmaceutical preparations or in the manufacture of bay rum or perfumed spirits; for every such licence granted for the manufacture of bay rum or perfumed spirits there shall be paid to the Accountant General the sum of $500.

    (7)   A licence under the preceding subsection may be granted, renewed or revoked in like manner and shall bear the like penalty for infringement as in subsections (2), (3) and (4) provided for a licence to use a still. (Amended by Act 2 of 1992)
