48.   Exclusion of hearsay evidence

    (1)   Evidence of a previous representation made by a person is not admissible to prove the existence of a fact that the person intended to assert by the representation.

    (2)   Where evidence of a previous representation is relevant otherwise than as mentioned in subsection (1), that subsection does not prevent the use of the evidence to prove the existence of an asserted fact.

    (3)   In this Part “asserted fact” means a fact referred to in sub-section (1).
