166.   Prohibition on publication

  1.  

    (1)   Despite subsection (2), a judge shall, in the case of a sexual offence, order a ban on the publication or broadcast of the identity of the complainant unless the complainant consents to the publication or broadcast.

    (2)   Where it appears to a court that—

    1.  

      (a)     the publication or broadcast of evidence, given or intended to be given, in proceedings before the court, is likely to prejudice the administration of justice; or

    1.  

      (b)     in the interests of the administration of justice it is desirable that the name of a party to, or a witness, or intended witness, on such proceedings not be published or broadcast,

    the court may, at any time during the hearing of the proceedings make an order forbidding the publication or broadcast of the name of such a party or witness, or the publication or broadcast of the evidence or a specified part of the evidence, or of report of the evidence, either absolutely or subject to such conditions as the court specifies or for such period as is specified.

    (3)   Where a court makes an order pursuant to subsection (1) or (2), the court may, if it thinks fit, also direct that the persons specified by the court, or all other persons except persons so specified, shall remain outside the court room for such period as the court specifies.
