159.   Attendance of witnesses and production of documents

  1.  

    (1)   Where any order is made for the examination of witnesses within the jurisdiction of the High Court by authority of this Act, it shall be lawful for the court in and by the first order to be made in the matter or any subsequent order—

    1.  

      (a)     to command the attendance of any person named in that order for the purpose of being examined or the production of any writings or other documents to be mentioned in that order; or

    1.  

      (b)     to direct the attendance of that person to be at his or her own place of abode or elsewhere if necessary or convenient so to do.

    (2)   Willful disobedience of an order made under subsection (1) shall be deemed to be contempt of court.

    (3)   Every person whose attendance is required pursuant to this section shall be entitled to the like conduct, money and payment for expenses and loss of time as upon attendance at a trial.

    (4)   A person shall not be compelled to produce any writing or other document under an order pursuant to subsection (1), that he or she would not be compelled to produce at a trial of the cause.
