10.   Penalties

  1.  

    (1)   Any person who contravenes —

    1.  

      (a)     Article 31; or

    1.  

      (b)     Article 32,

commits an offence and is liable on conviction to a fine not exceeding $250,000 or to imprisonment for a term not exceeding 3 years or to both.

  1.  

    (2)   Any person who contravenes Article 34 or submits or causes to be submitted any information that is materially false or misleading commits an offence and is liable on conviction to a fine not exceeding $250,000 or to imprisonment for a term not exceeding 3 years or to both.

  1.  

    (3)   Any person who contravenes —

    1.  

      (a)     Article 35;

    1.  

      (b)     paragraph (1) or (2) of Article 36;

    1.  

      (c)     paragraph (1) of Article 37;

    1.  

      (d)     Article 38;

    1.  

      (e)     Article 40; or

    1.  

      (f)     paragraph (1) of Article 46,

commits an offence and is liable on conviction to a fine not exceeding $250,000 or to imprisonment for a term not exceeding 5 years or to both.

  1.  

    (4)   Any person who contravenes Article 97 commits an offence and is liable on conviction to a fine not exceeding $250,000 or to imprisonment for a term not exceeding 3 years or to both.
