7.   Incidents of Ownership of Unit

  1.  

    (1)   The undivided share of each unit owner in the common property shall be in the same proportion as his or her unit entitlement and shall be held in undivided ownership with all other persons who are unit owners in the building to which the declaration relates.

    (2)   A share in the common property shall not be disposed of except as appurtenant to the unit to which it relates and any contract for the disposal of a unit shall operate to dispose of the share of the disposing party in the common property without express reference thereto.

    (3)   Despite the provisions of the Civil Code and the Code of Civil Procedure with respect to the partitioning of property in undivided ownership no unit owner or other person shall be entitled to bring any action for partition or the division of any part of or interest in the common property save in the case provided by section 31.

    (4)   The unit entitlement of any unit shall determine the quantum of the undivided share in the common property appertaining to each unit and unless the declaration or the bye-laws otherwise provide—

    1.  

      (a)     the voting rights of the unit owner; and

    1.  

      (b)     the proportion of the common expenses payable as contributions by each unit owner; and

    1.  

      (c)     the interest of a unit owner in the property upon termination of the application of this Act to the property.

  1.  

    (5)   The unit entitlement shall have a permanent character and shall not be varied unless all the unit owners affected consent thereto, such consent being given in the manner prescribed by the relevant declaration.

    (6)   Unless other provision to the contrary is contained in the relevant declaration, no unit owner shall be entitled to sub-divide his or her unit.
