CITIZENSHIP OF SAINT LUCIA REGULATIONS

Commencement [24 July 1982.]

1.   Citation

These Regulations may be cited as the Citizenship of Saint Lucia Regulations.

2.   Definition

In these Regulations—

Act” means the Citizenship of Saint Lucia Act;

CARICOM National” means a national belonging to one of the member countries of the Caribbean Community, but for the purposes of these Regulations it does not include a person born of Saint Lucian parentage in a member country of the Caribbean Community;

Commonwealth Citizen” means a citizen of a country belonging to the Commonwealth, but for the purposes of these Regulations it does not include the member countries of the Caribbean Community;

Minister” means the Minister to whom matters relating to citizenship have been assigned.

3.   Application under section 3 of the act

  1.  

    (1)   Where a person seeks the advice of the Minister in regard to his or her citizenship under section 3 of the Act he or she shall apply to the Minister in the form set out as Form 1 in Schedule 1.

    (2)   Where a person seeks the advice of the Minister in regard to the citizenship of a child born outside Saint Lucia to a citizen of Saint Lucia by descent he or she shall apply to the Minister in the form set out as Form 2 in Schedule 1.

4.   Application under section 6 of the act

  1.  

    (1)   An application for registration as a citizen of Saint Lucia under section 6(1) or 6(2) of the Act shall be in the form set out as Form 3 in Schedule 1.

  1.  

    (2)   An application for registration as a citizen of Saint Lucia of a minor under section 6(3) of the Act by the parents or guardian of such child shall be in the form set out in Form 4 in Schedule 1.

5.   Certificate of Registration

  1.  

    (1)   A person registered as a citizen of Saint Lucia under an application made under section 6(1) or 6(2) of the Act, shall be granted a certificate of registration in the form set out as Form 5 in Schedule 1.

  1.  

    (2)   A minor registered as a citizen of Saint Lucia under an application made under section 6(3) of the Act or under the direction of the Minister under section 7(2) of the Act shall be granted a certificate of registration in the form set out as Form 6 in Schedule 1.

6.   Form of Application for Certificate of Naturalisation

  1.  

    (1)   An application for the grant of a certificate of naturalisation made under section 8(1) of the Act shall be in the form set out as Form 7 in Schedule 1 and shall be forwarded to the Minister with 2 separate issues of a newspaper in circulation in Saint Lucia each containing (clearly marked) an advertisement in the form set out as Form 8 in Schedule 1.

    (2)   A declaration of renunciation under section 8(3) of the Act shall be in the form set out as Form 9 in Schedule 1.

    (3)   Where a person renounces the citizenship of any other country such renunciation will be effective from the date of receipt of the certificate of registration of renunciation from that country; the Minister shall then cause such renunciation to be published in the Saint Lucia Gazette.

7.   Form of Certificate of Naturalisation

A certificate of naturalisation granted under section 8(1) of the Act shall be in the form set out as Form 10 in Schedule 1.

8.   Form of declaration of renunciation of citizenship of Saint Lucia

A declaration of renunciation of citizenship of Saint Lucia made under section 10(1) of the Act shall be in the form set out as Form 11 in Schedule 1 and registered at the office of the Minister.

9.   Establishment and maintenance of registers

There shall be established and maintained registers to be kept by the Permanent Secretary to the Minister and all matters required by the Act or these Regulations to be registered shall be entered in the appropriate registers.

10.   Authority to whom application shall be made

  1.  

    (1)   Subject to subsection (2) application for a certificate of citizenship or naturalisation or for registration as a citizen of Saint Lucia shall be made to the Minister.

  1.  

    (2)   Where an application is made by or on behalf of a person residing in a country other than Saint Lucia for a certificate of citizenship under section 6 of the Act, the application shall be submitted to a Saint Lucia diplomatic agent or a Saint Lucia consular officer acting as such on behalf of the Government of Saint Lucia in that country and the diplomatic agent or consular officer shall grant a certificate of citizenship in the form set out as Form 5 or 6 (as the case may be) in Schedule 1.

    (3)   Where a person is so registered as a citizen of Saint Lucia, a copy each of this application and the certificate of registration shall be forwarded to the Minister.

11.   Signing of certificates of citizenship

A certificate of citizenship, registration or naturalization issued under the Act shall be signed by—

  1.  

    (a)     the Permanent Secretary to the Minister; or

  1.  

    (b)     the Deputy Permanent Secretary to the Minister; or

  1.  

    (c)     a Saint Lucia diplomatic agent; or

  1.  

    (d)     a Saint Lucia consular officer.

12.   Deprivation of citizenship

  1.  

    (1)   Where a person is to be deprived of his or her citizenship under section 9 of the Act a notice shall be given to him or her in the following manner—

    1.  

      (a)     where that person's whereabouts are known by causing the notice to be delivered to him or her personally or by sending it to him or her by registered post;

    1.  

      (b)     where that person's whereabouts are not known, by sending it to him or her by registered post to his or her last known place of abode or business.

  1.  

    (2)   Subject to subsection (3) where the Minister has given notice referred to in subsection (1) and the person to whom it is given has the right to request an inquiry under the Act the request shall, where that person is in Saint Lucia or not at the time when the notice is given be made within such time not being less than 21 days from the giving of the notice, as the Minister may determine.

    (3)   The Minister may in special circumstances extend the time within which a request for an inquiry may be made.

13.   Deprivation of citizenship

Where an order has been made depriving a person of citizenship of Saint Lucia—

  1.  

    (a)     that person's name shall be removed from the register of citizens of Saint Lucia;

  1.  

    (b)     that person shall, if so required by notice in writing given by the Minister, surrender his or her certificate of registration, naturalisation or citizenship as the case may be, to such person and within such time as may be specified in the notice, and the certificate of registration, naturalisation or citizenship shall thereupon be cancelled.

14.   Persons before whom an application or declaration may be made or by whom oath of allegiance may be administered

An application or declaration made in accordance with the Act and these Regulations shall not be accepted or registered and the oath of allegiance required by the Act shall be of no effect unless it is signed in the presence of or administered by one of the following persons—

  1.  

    (a)     in Saint Lucia, a justice of the peace, an attorney-at-law, or a person authorised by law to administer oaths for any judicial or other legal purpose;

    (b)     in any other country, a Saint Lucia diplomatic agent or a Saint Lucia consular officer in that country.

15.   Oath of Allegiance

Where a person is required by the Act to take an oath of allegiance he or she shall take such oath in the form set out as Form 12 in Schedule 1.

16.   Evidence

A document may be certified to be a true copy of a document for the purpose of the Act by means of a statement in writing to that effect signed by a person authorised by the Minister in that behalf.

17.   Fees

The fees set out in Schedule 2 shall be imposed and applied in the manner specified therein.
