CENSUS REGULATIONS – SECTION 5

Commencement [10 February 2001]

1.   Citation

These regulations may be cited as the Census Regulations.

2.   Interpretation

In these Regulations, unless the context otherwise requires—

Act” means the Statistics Act;

authorised official” means a person authorised in writing by the census officer;

census” means the census directed to be taken by the Order;

census day” means the date prescribed by the Cabinet for conducting a census;

census forms” means the forms set out in Schedule 2;

census information” means any information necessary for the making of true and accurate entries in a census form;

census night” means midnight of the date prescribed for conducting a census;

census officer” means the person appointed under section 3 of the Census Act;

enumeration district” means any one of the districts into which Saint Lucia is divided under regulation 6;

Enumerator” means a person appointed as such under regulation 7;

Order” means the Census Order, 2001;

Supervisor” means a person appointed as such under regulation 7;

vessel” includes any ship or boat or any other description of vessel used or designated to be used in navigation.

3.   Census information to be furnished

On the taking of the census, census information shall be furnished as follows—

  1.  

    (a)     by every adult person with respect to himself or herself and all children or others for whom he or she may be responsible and who pass census night in Saint Lucia;

  1.  

    (b)     by the head, or any other responsible member, of a household with respect to himself or herself and all persons who pass census night on the premises of that household;

  1.  

    (c)     by the proprietor or manager of a hotel, guest house, boarding house, boarding school, orphanage, hostel or other similar institution or any person authorised by such proprietor or manager, with respect to all persons who pass census night on the premises of that institution;

  1.  

    (d)     by the person in charge of a public or private hospital, nursing home, alms house, house for the aged and infirm, or other similar institution with respect to all persons who pass census night on the premises of that institution;

  1.  

    (e)     by the superintendent of a prison with respect to all persons who pass census night on the premises of that prison;

  1.  

    (f)     by the police officer in charge of a police station or lock-up with respect to all persons who pass census night on the premises of that police station or lock-up; and

  1.  

    (g)     by the master of a vessel with respect to all persons who pass census night aboard that vessel.

4.   Particulars to be furnished

The particulars to be furnished on the taking of the census shall be in accordance with Schedule 1.

5.   Census forms

Particulars and information prescribed in regulations 3 and 4 shall be furnished on the forms set out as Forms 2 and 3 in Schedule 2.

6.   Division of country into districts

For the purpose of the census the census officer or any person designated by him or her shall divide Saint Lucia into enumeration districts and shall prepare a detailed description in writing of every enumeration district and boundaries.

7.   Appointment, assignment and termination of Supervisors and Enumerators to districts
  1.  

    (1)   The census officer or any person designated by him or her may appoint an authorised official to be—

    1.  

      (a)     a supervisor for one or more enumeration districts to assist in the training of enumerators and to supervise enumerators in the execution of their duties; and

    1.  

      (b)     an enumerator to collect census information.

  1.  

    (2)   A supervisor may be assigned to an appropriate number of enumeration districts and an enumerator may be assigned to one or more enumeration districts.

  1.  

    (3)   Notice of the appointment or the cancellation of appointment of a supervisor or an enumerator shall be published in the Gazette and in at least one weekly newspaper circulating in Saint Lucia.

  1.  

    (4)   Where it appears to the census officer or a person designated by him or her that a supervisor or enumerator is unfit to perform his or her duties under the Act or these Regulations, the census officer or a person designated by him or her may terminate his or her appointment and may appoint some fit and proper person in his or her place to perform those duties.

8.   Duties of Supervisor

A supervisor shall—

  1.  

    (a)     give all necessary instructions to enumerators in his or her enumeration district or districts;

  1.  

    (b)     issue to enumerators all census forms and other articles necessary for the taking of the census;

  1.  

    (c)     examine before census day all entries made in census forms by enumerators and, where it appears upon examination that any census information in any form is defective or has been omitted, he or she shall require the enumerator responsible for filing up the form to take steps to correct the defective information before census day;

  1.  

    (d)     arrange for the enumeration of all persons in his or her enumeration district or districts;

  1.  

    (e)     receive, examine and transmit all completed census forms and other articles delivered to him or her, by the enumerators under his or her control to, and within the time prescribed by, the census officer or the person designated by him or her;

  1.  

    (f)     arrange for the carrying out of such check on the field after census day as directed by the census officer or the person designated by him or her;

  1.  

    (g)     notify every permanent change of his or her address to the census officer or the person designated by him or her within 2 days of his or her removal;

  1.  

    (h)     carry out generally all instructions issued to him or her by the census officer or the person designated by him or her for the purpose of taking the census; and

  1.  

    (i)     notify the census officer or the person designated by him or her whenever it appears necessary to replace any enumerator who may be unable to carry out his or her duties on census night.

9.   Duties of Enumerator

An enumerator shall—

  1.  

    (a)     notify every permanent change of his or her address to the supervisor of his or her enumeration district and to the census officer or the person designated by him or her within 2 days of his or her removal;

  1.  

    (b)     preserve carefully any written instructions, books, forms, documents or any other articles or things issued to him or her in connection with his or her duties and return them in good condition to the supervisor of his or her enumeration district on the conclusion of the enumeration or when called upon to do so;

  1.  

    (c)     by the census officer or person designated by him or her every building in his or her enumeration district to obtain all information necessary for the filling up of the census forms and to fill up accurately and faithfully census forms with respect to every such building;

  1.  

    (d)     make further visits to buildings, if on a first visit thereto the required information cannot be obtained and on the direction of the supervisor re-visit any dwelling for the purpose of supplying omissions or correcting or verifying entries in any census forms;

  1.  

    (e)     visit personally on the day after census day every inhabited dwelling in his or her enumeration district in order to ensure the accuracy of the census information with respect to persons who spent census night in their dwelling;

  1.  

    (f)     carry out generally such instructions of the census officer or of the person designated by him or her or of the supervisor of his or her enumeration district as may be issued for the purpose of taking the census;

  1.  

    (g)     meet the supervisor of the district at such times and places as the supervisor may direct;

  1.  

    (h)     assist the supervisor in the performance of his or her duties prescribed by regulation8(c) and 8(d) if so desired by the supervisor;

  1.  

    (i)     assist any other enumerator in the performance of his or her duties in any other district if so directed by the supervisor; and

  1.  

    (j)     carry out generally such instructions of the census officer or of the person designated by him or her or of the supervisor for the purpose of taking the census.

10.   Supervisor to make written declaration
  1.  

    (1)   A supervisor shall, on the acceptance of his or her duties, sign an acceptance of appointment form and make it in the presence of the census officer or the person designated by him or her or a justice of the peace a written declaration as to the due and faithful performance of his or her duties set out in Schedule 3.

  1.  

    (2)   A Supervisor shall, at the time when he or she transmits the census forms for his or her district or districts to the census officer or the person designated by him or her, make in the presence of the census officer or the person designated by him or her or a justice of the peace a written declaration as to the due and faithful performance of his or her duties in the form set out in Schedule 3.

11.   Enumerators to make written declaration
  1.  

    (1)   An enumerator shall, on the acceptance of his or her appointment and again on the completion of his or her duties make in the presence of the supervisor of the district a written declaration as to the due and faithful performance of his or her duties.

  1.  

    (2)   Such declaration shall be in accordance with the forms set out in Schedule 3, save that the form of “Enumerator's Declaration” at the conclusion of enumeration may be modified to take account of any duties which have been laid upon the enumerator under regulation8(c) and 8(f).

12.   Duty of a person to give information to Enumerator

A person with respect to whom census information is required by paragraph 4 of the order to be furnished shall upon demand give to an enumerator such information with respect to himself or herself as may be necessary for the purpose of taking the census.

13.   Duty of a person to give information to Enumerator

A person, who is required by paragraph (5)(i) of the Order to furnish census information with respect to other persons, shall upon demand furnish to an enumerator such information with respect to those other persons as may be necessary for the purpose of taking the census.

14.   Duty of a person to give information to prescribed persons

A person with respect to whom it is the duty of another person prescribed by paragraph 5(ii)–5(iv) of the Order to furnish census information shall upon demand give such information to that prescribed person as may be necessary for the purpose of taking the census.

15.   Destruction or mutilation of documents prohibited

A person being a person employed in the execution of any duty under these Regulations, shall not knowingly destroy, deface or mutilate any document.

16.   Penalties

Enumerators and supervisors are liable to prosecution under section 9 of the Act for divulging information obtained during the conduct of the census.

Schedule 1

(Regulation 4)

CENSUS QUESTIONNAIRE

Information will be required as follows—

  1.  

    1.   In respect of every inhabited building and dwelling, the type of building and dwelling, type of tenure, type of land occupancy, material of outer walls, material used for roofing, year when built, water supply, toilet facilities, type of lighting, fuel for cooking, type of kitchen, number of rooms and bedrooms, other facilities available such as radios, TV sets, videos, telephone, number of persons who have gone abroad by sex and age.

  1.  

    2.   In respect of every person—

    1.  

      (a)     the name, relationship to head of household, sex, date of birth, age, ethnic group and religion;

    1.  

      (b)     whether one suffers from long-standing illness, type of disability, whether disability limits activities, which activity does disability inhibit;

    1.  

      (c)     birthplace, normal residence, years of residence, place of previous residence;

    1.  

      (d)     attendance at school, type of school now being attended, address of school, mode of travel to school, highest level of educational attainment, standard reached, highest examination ever passed; and

    1.  

      (e)     membership in household on census night.

  1.  

    3.   In respect of females 15 years old and over and not attending primary or secondary school full-time—

    1.  

      (a)     total number of children born alive, age of mother at birth of first child born alive, age of mother at birth of last child born alive, number of live and still births during the past 12 months; type of births that occurred during the past 12 months; deaths that occurred to births during the last 12 months; and

    1.  

      (b)     type of union.

  1.  

    4.   In respect of all persons 15 years old and over—

    1.  

      (a)     main activity during the past 12 months, how many months worked during the past 12 months;

    1.  

      (b)     main activity during the week preceding enumeration, type of job in which engaged for most of the past week, type of business carried on by the employer, hours worked during the week preceding enumeration, whether work is dependent on tourism, name and address of business place, method of travel to and form work, occupation status during the past week;

    1.  

      (c)     particulars of income; and

    1.  

      (d)     field of highest level of training, main method of training, period of training, type of occupation training prepares one for.
