8.   Surrender proceedings

  1.  

    (1)   At the beginning of the proceedings for the surrender of a requested person under section 7(a) or (b), the judicial authority shall ask the requested person if he or she consents to being surrendered.

  1.  

    (2)   The judicial authority shall inform the person who —

    1.  

      (a)     consents to be surrendered under subsection (1); and

    1.  

      (b)     the judicial authority is satisfied consents voluntarily, that he or her shall be —

      1.  

        (i)     committed to a correctional facility without further proceedings, and

      1.  

        (ii)     returned to the issuing State Party as soon as practicable.

  1.  

    (3)   If the person maintains his or her consent to being surrendered after being informed by the judicial authority under subsection (2), the judicial authority shall order that the requested person be —

    1.  

      (a)     surrendered to the issuing State Party; and

    1.  

      (b)     committed to a correctional facility until the requested person is returned to the issuing State Party.

  1.  

    (4)   If the judicial authority determines that the requested person must be surrendered, the judicial authority shall —

    1.  

      (a)     record in writing his or her decision and the applicable offence for which the requested person is to be surrendered; and

    1.  

      (b)     give a copy of the record under paragraph (a) to the requested person and to the Attorney General.
