(1) Probate of a will in respect of a succession consisting of movable or immovable property, not exceeding $5,000 in value may, upon production of such will and of an affidavit verifying the due execution and publication thereof, be issued to the executor named in such will, or, in the alternative an administrator of the estate may be appointed by order of a judge in any case where it shall appear to the judge to be necessary or convenient so to do.
