28.   Concealing or transferring proceeds of criminal conduct

  1.  

    (1)   A person shall not —

    1.  

      (a)     bring into or remove from Saint Lucia;

    1.  

      (b)     disguise, conceal, invest, manage or engage in any transaction in Saint Lucia; or

    1.  

      (c)     convert or transfer,

any property which in whole or in part directly or indirectly represents the proceeds of criminal conduct.

    (2)   In proceedings against a person for an offence under subsection (1), it is a defence to prove that the person was carrying out a function relating to the enforcement of any provision of this Act. (Substituted by Act 13 of 2013 and by Act 20 of 2016)

    (3)   For the purposes of subsection (1), “disguise or conceal” includes disguising or concealing the disposition, location, movement, nature, ownership or any right of the property. (Inserted by Act 20 of 2016)

    (4)   A person who contravenes subsection (1) or (2) commits an offence and is liable —

    1.  

      (a)     on summary conviction to a fine of not less than $0.5 million and not exceeding $5 million or to imprisonment for a term of not less than 5 years and not exceeding 10 years or both; (Amended by Act 16 of 2021)

      (b)     on conviction on indictment to a fine of not less than $1million and not exceeding $10 million or to imprisonment for a term of not less than 10 years and not exceeding 15 years or both. (Amended by Act 16 of 2021)
