3.   Purposes for which collections are permitted

  1.  

    (1)   Subject to the provisions of subsection (2), this Act applies to the collection of money and to the sale of articles in any street or other public place for the benefit of charitable or other purposes, and any person who acts in contravention of any of the provisions of this Act is liable on summary conviction to a fine of $10 or in the case of a second or subsequent offence to a fine of $48.

    (2)   This Act shall not apply to the selling of articles in any street or other public place when the articles are otherwise lawfully sold in the ordinary course of trade and no representation is made by or on behalf of the seller that any part of the proceeds of sale will be devoted to any other purpose.
