40.   Power of search without warrant

  1.  

    (1)   Subject to subsections (2) and (3) where a police officer has reasonable cause to suspect that any person has concealed about his or her person any offensive weapon contrary to section 36, he or she may without warrant search such person and, if he or she considers it necessary, take such person to a police station for the purpose.

    (2)   An article of a person's clothing shall not be removed for the purposes of any search unless such person is first taken to a police station.

    (3)   A female shall not be searched by any person other than a female police officer.

    (4)   A person who resists or obstructs any search authorised by this section or who absconds before such search is completed commits an offence.
