39.   Unlawful statements

  1.  

    (1)   A person who commits an offence under this section if he or she publishes or otherwise communicates to any other person any unlawful statement, and any person who commits an offence under this section is liable on summary conviction to a fine not exceeding $2,500 or to imprisonment for a term not exceeding 2 years or to both such fine and imprisonment.

    (2)   In this section—

“unlawful statement” means a statement that is calculated—

  1.  

    (a)     to incite any person to attempt to procure otherwise than by lawful means the alteration of any matter by law established in Saint Lucia;

    (b)     to cause disaffection amongst the police officers, or to induce or attempt to induce a police officer to withhold his or her services or to bring the Police Force into hatred or contempt;

  1.  

    (c)     to incite any person to commit any crime prejudicial to public order or to public safety;

  1.  

    (d)     to engender or promote feelings of hostility to or contempt for any section of the public of Saint Lucia on account of race, colour, religion or profession, calling or employment;

  1.  

    (e)     to incite any of Her Majesty's subjects to obtain by force or other unlawful means of an alteration in the laws or in the form of Government of Saint Lucia or to the commission of any offence punishable under sections 307 to 310 of the Criminal Code;

publishing” in relation to an unlawful statement means publish the statement by itself or as part of a newspaper or periodical or otherwise or in sound or in visual images with or without sound, in movement or at rest for distribution to the public.
