37.   Incitement to racial hatred at meetings and marches

  1.  

    (1)   A person who—

    1.  

      (a)     publishes or distributes at a public meeting or during the course of a public march written matter which is threatening, abusive or insulting; or

    1.  

      (b)     uses at a public meeting or during the course of a public march words which are threatening abusive or insulting,

    being matter or words that may reasonably be interpreted as likely to stir up or capable of stirring up hatred against any section of the public of Saint Lucia distinguished by race, colour, religion, profession, calling or employment commits an offence.

    (2)   In this section—

“publish” and “distribute” means publish and distribute to the public at large or to any section of the public not consisting exclusively of members of an association of which the member publishing or distributing is a member;

“written matter” includes any writing sign or visible representation.

    (3)   A person who commits an offence under this section is liable on summary conviction to a fine not exceeding $2,500 or to imprisonment for a term not exceeding 2 years or to both such fine and imprisonment.
