34.   Offence to break up public meeting

  1.  

    (1)   Any person who at a lawful public meeting acts or incites any other person to act in a disorderly manner likely to prevent or obstruct or for the purpose of preventing or obstructing the transaction of the business of the meeting commits an offence under this section.

    (2)   If a police officer has reasonable cause to suspect any person of committing an offence against subsection (1) he or she may require that person to leave the meeting immediately.

    (3)   If the Chairperson of the meeting has reasonable cause to suspect any person of committing an offence against subsection (1) he or she may call on a police officer to request such person to desist from the conduct which would give rise to such offence being committed and if such person after the request continues with such conduct such police officer shall request that person to leave the meeting immediately.

    (4)   Any person who, having been required to leave any meeting by a police officer under subsection (2) refuses or fails immediately to leave such meeting commits an offence.

    (5)   For the purpose of this section, a person shall be deemed not to have left a meeting if he or she is in any public place from which the Chairperson of the meeting or any speaker addressing the meeting is visible.
