Public Jetties Rules – Section 6

PUBLIC JETTIES RULES – SECTION 6

1.     A jetty in any town or village is under the charge and control of the local authority having jurisdiction over such town or village.

2.     The local authority shall regulate the traffic on any jetty and any dispute as to precedence or otherwise with regard to the use of such jetty or the passing of any goods thereon shall be determined by the Local Authority. However, coasting steamers drawing subsidy from the Government shall have precedence over all other vessels in respect of the use of the jetty.

3.     A ship, boat, or craft of any kind shall not be made fast to or lie alongside of any jetty except for the purpose of landing or taking in passengers and cargo.

4.     A ship, boat, or craft coming or lying alongside of any jetty shall be provided with proper fenders or buffers and take all reasonable precaution to prevent damage to the jetty.

5.     Any damage caused to any jetty and the circumstances of such damage, with the name of the person, ship, boat, or craft causing such damage and, where possible, the name of the master or owner of such ship, boat, or craft, and the estimated value of such damage, shall at once be reported by the Local Authority in charge of such jetty to the Chief Engineer.

6.     Goods shall not be allowed to remain on any jetty longer than is necessary to remove the same to their destination on shore or on board of any ship, boat, or craft, or so as to cause any obstruction to the use of such jetty; and any goods remaining on any jetty in contravention of this rule may be removed by the Local Authority or his or her assistants to the Local Authority's Office or other place of security, at the cost of the owner thereof; and the expense of such removal may be recovered by the Local Authority before any court of competent jurisdiction.

7.     Where the owner of such goods is present, the Local Authority may order him or her to remove the same from the jetty, if they are lying thereon in contravention of the preceding rule.

8.     Goods shall not be landed on or shipped from any jetty before 5:00 a.m., or after 6:00 p.m., except with the permission of the local authority.

9.     A ship, boat or craft shall not, except with the permission of the local authority, anchor or lie near to any jetty so as to endanger the security of such jetty; and the master of any ship, boat or craft anchored or lying near to any jetty in contravention of this rule may be ordered by the local authority to remove such ship, boat or craft from the neighbourhood of such jetty.

10.     An article or package exceeding 1 1/2-ton in weight shall not be landed or placed upon any jetty without the special permission of the local authority, except machinery and appliances required for the repair of such jetty and except horses and cattle.

11.     Offal, dirt, refuse or rubbish of any kind or any foul liquid matter shall not be thrown on or from any jetty.

12.     A crowd shall not collect or remain upon any jetty so as to obstruct the free passage thereon or to endanger the security thereof, and the local authority may at any time order the dispersal of any such crowd.

13.     Warps or fasts shall not be laid out to any jetty except by a ship, boat or craft coming alongside or intending to come alongside thereof.

14.     A person shall not molest, hinder, oppose or obstruct any local authority, or any one authorised by him or her in the lawful execution of his or her duties under the rules.

15.     Any person disobeying any lawful order of or from the local authority commits an offence against the rules.

16.     The word “jetty” means any public jetty as defined by the Public Jetties Act.

17.     The word “owner” includes the agent of the owner or any person actually in charge of or conveying any package or other article to or from any ship.

18.     The expression “local authority” means any local authority constituted under and by virtue of the Local Authorities Act.
