5.   Offences

  1.  

    (1)   A person shall not—

    1.  

      (a)     make any false statement for the purpose of obtaining a passport;

    1.  

      (b)     make any statement on an application for a passport which he or she knows to be false;

    1.  

      (c)     intentionally deface, damage or destroy any passport;

    1.  

      (d)     forge any passport;

    1.  

      (e)     unlawfully produce any passport;

    1.  

      (f)     sell forged passports; or

    1.  

      (g)     conspire with another person to do any of the acts listed in paragraphs (a) - (f).

    (2)   A person who contravenes—

    1.  

      (a)     subsection (1)(a), (b) or (c) commits an offence and is liable on summary conviction to a fine of $5,000; and (Amended by Act 20 of 2011)

      (b)     subsection (1)(d) commits an offence and is liable on summary conviction to a fine of $25,000 or to imprisonment for 7 years;

    1.  

      (c)     subsection (1)(e) commits an offence and is liable on summary conviction to a fine of $50,000 or imprisonment for 15 years;

    1.  

      (d)     subsection (1)(f) commits an offence and is liable on summary conviction to a fine of $30,000 or to imprisonment for 10 years;

    1.  

      (e)     subsection (1)(g) commits an offence and is liable on summary conviction to a fine of not less than $500 nor more than $10,000.

    (3)   Where the offence under subsection (1) involves the use of equipment to make passports, the Court shall, in addition to the penalty specified under subsection (2), declare that the equipment be forfeited to the State.
