7.   Complaints against the police

  1.  

    (1)   Where a complaint made to the Commissioner concerns a member of the Royal Saint Lucia Police Force, the Commissioner shall forward such complaint to the Commissioner of Police for investigation and report.

    (2)   On receipt of a complaint from the Commissioner, the Commissioner of Police shall either investigate the complaint himself or herself or cause an investigation to be carried out by an investigating officer and may take or cause to be taken such action in relation thereto as he or she considers appropriate.

    (3)   On completion of an investigation requested by the Commissioner, under this section, the Commissioner of Police shall forward a report to the Commissioner indicating therein any action which has been taken in the matter.

    (4)   On receipt of a report from the Commissioner of Police, the Commissioner may—

    1.  

      (a)     where action has been taken in relation to the matter which was investigated, decide that the action taken was appropriate in the circumstances; or

    1.  

      (b)     where no action has been taken or where the Commissioner is of the opinion that the action taken was inappropriate to the circumstances of the investigation he or she may carry out an investigation himself or herself and at the close thereof indicate to the Commissioner of Police such remedial action as he or she considers appropriate.
