7.   Powers and duties of Authority

  1.  

    (1)   The powers and duties of the Authority to be exercised in accordance with this Act are as follows—

    1.  

      (a)     to consider an application for a licence;

    1.  

      (b)     to make recommendations to the Minister on the grant of a licence to an applicant;

    1.  

      (c)     to verify or cause to be verified the background character and reputation of an applicant;

    1.  

      (d)     to keep under review the extent, character and location of gaming activities licensed under this Act;

    1.  

      (e)     to inspect or cause to be inspected a gaming device or associated equipment proposed to be used in Saint Lucia;

    1.  

      (f)     to issue a list of persons to be excluded from a gaming establishment or from participating in gaming;

    1.  

      (g)     to grant a provisional betting provider licence; (Substituted by Act 24 of 2019)

      (h)     to make recommendations to the Minister on the making of Regulations for the integrity of gaming and the need for sufficient business discretion on the part of the gaming operator to enable efficiency and profitability; (Substituted by Act 24 of 2019)

      (i)     to enforce this Act; (Inserted by Act 24 of 2019)

      (j)     to perform other duties as are assigned to it by the Minister. (Inserted by Act 24 of 2019)

    (2)   A list issued under subsection (1)(f) may include a person with—

    1.  

      (a)     prior convictions for an indictable offence, a crime involving moral turpitude or conspiracy to violate laws relating to gaming including this Act;

    1.  

      (b)     notorious or bad reputation that would adversely affect public confidence in the fact that the gaming industry is free from criminal or corrupt elements.

  1.  

    (3)   In enforcing the provisions of this Act the Board may conduct any investigation it considers necessary in relation to a licensee and may perform any of the following in the course of such investigation—

    1.  

      (a)     compel the production of documents and records in the custody or control of a licensee;

    1.  

      (b)     compel the appearance of an employee or officer of a licensee or any other person for the purpose of ascertaining compliance with this Act;

    1.  

      (c)     inspect, examine and make copies of any document or record in the possession of a licensee relevant to gaming activities;

    1.  

      (d)     require verification of income and all other matters pertinent to the licensee's gaming activities;

    1.  

      (e)     inspect a place where gaming activities are conducted and inspect all property connected with gaming activity;

    1.  

      (f)     seize, remove and impound any gaming device or associated equipment, document or records for the purpose of examination or inspection.
