REGULATION OF GAMING

25.   Regulation of gaming operator

  1.  

    (1)   An applicant for a gaming operator licence under section 16 shall submit, along with the prescribed application form, a proposed business plan which shall include—

    1.  

      (a)     a floor plan of the area to be used for gaming;

    1.  

      (b)     a marketing plan;

    1.  

      (c)     the proposed number of games and the placement of the gaming devices and associated equipment;

    1.  

      (d)     a set of the rules intended to govern the gaming activities, including stipulations as to the maximum bet and hours of play;

    1.  

      (e)     a financial control plan;

    1.  

      (f)     a security plan; (Amended by Act 24 of 2019)

      (g)     a staffing plan; and (Amended by Act 24 of 2019)

      (h)     a surveillance plan. (Inserted by Act 24 of 2019)

    (2)   A gaming operator licence shall be granted by the Board to an applicant for the operation of a specific number and types of games at approved premises and new or additional games may only be operated with the prior approval of the Board. (Amended by Act 24 of 2019)

    (3)   A person shall not carry out gaming at a gaming establishment unless the Board has—

    1.  

      (a)     approved the rules governing the game;

    1.  

      (b)     conducted a physical inspection of the gaming establishment and the gaming devices and associated equipment to be used; and

    1.  

      (c)     has approved the gaming devices or associated equipment.

  1.  

    (4)   The Board may approve, amend or reject any rules proposed for a game.

    (5)   A gaming operator shall ensure that at all times a copy of the rules, limits and odds for each game as approved by the Board, is posted in a prominent and visible place within the gaming establishment.

    (6)   A gaming operator shall place at all entrances to the gaming establishment prominent signs containing information on the admission policy, age, nationality and any other restrictions imposed under this Act.

    (7)   The Board may, at any time, require the removal or prohibit the use of any gaming device or associated equipment which in the Board's judgement does not offer a fair opportunity to the public. (Amended by Act 24 of 2019)

    (8)   A gaming operator shall, at all times, prominently display his or her licence to carry out gaming within the gaming establishment.
