LICENSING OF GAMING AND BETTING ACTIVITIES

13.   Requirement for licence

  1.  

    (1)   A person shall not—

    1.  

      (a)     conduct gaming;

    1.  

      (b)     manufacture, fabricate, assemble, programme or, in the case of gaming, modify a gaming device or associated equipment; (Amended by Act 24 of 2019)

      (c)     sell, supply or distribute a gaming device or associated equipment;

    1.  

      (d)     lease gaming machines to a gaming operator in exchange for remuneration based on earnings in profit from a gaming operation;

      (e)     offer live betting, non-remote or remote betting and other activities approved by the Board; (Inserted by Act 18 of 2018 and substituted by Act 24 of 2019)

      (f)     (Inserted by Act 18 of 2018 and deleted by Act 24 of 2019)

unless the person has been issued an appropriate licence under this Act or is a person who operated a gaming machine prior to the commencement of this Act and has the approval of the Authority to continue to do so under subsections (4) and (5).

    (2)   A person who contravenes subsection (1) commits an offence and upon summary conviction is liable to a fine not exceeding $150,000 or to a term of imprisonment not exceeding 3 years or both.

    (3)   A person convicted of an offence under subsection (1) shall not be granted any licence under this Act for a period of 5 years from the date of the offence and the Board may, after the 5 year period, on the application of the person convicted, grant permission to the person convicted to apply for a licence under this Act.     (4)   A person who operated a gaming machine prior to the commencement of this Act may apply to the Authority for approval to continue to operate the gaming machine until the life of the particular machine has expired and the Authority may subject to subsection (5) grant the approval.

    (5)   The approval of the Authority shall be in writing and shall be subject to conditions specified by the Authority and to the condition that the person shall not import any parts for the gaming machine, or any new gaming machines unless in accordance with the other provisions of this Act.

    (6)   Where a person breaches the conditions of an approval given under subsections (4) and (5), the Authority may revoke the approval.

    (7)   In this section “operate a gaming machine” means to do anything listed in subsection (1)(a), (c) or (d) and “operated a gaming machine” shall be construed accordingly.
