8.   Notice of intention to be a timber dealer

  1.  

    (1)   A person shall not deal in timber unless he or she notifies the fact of his or her being such dealer and the place or premises at which he or she intends to conduct his or her timber business to the Chief Forest Officer, and, so long as he or she so deals, notifies such fact as aforesaid within the first 15 days of January and July in each year. The Chief Forest Officer shall give such dealer a certificate to the effect that such notification has been made.

    (2)   A dealer who contravenes any provisions of subsection (1) is liable to a penalty of not exceeding $1000 irrespective of and in addition to any other punishment to which he or she may be liable under this Act.

    (3)   For the purposes of this section a person deals in timber who by way of business buys and sells timber or otherwise acquires timber for purposes of trade and whether a person trades or not in timber is a question of fact in each case. (Amended by Act 11 of 1983)
