14.   Defective building, etc.

  1.  

    (1)   If the building in which a still is situated or any vessel, utensil, pipe or fitting of any still, is in so defective a condition that the Comptroller of Excise deems it inexpedient to allow the distilling of spirits in any such still, he or she may cause a notice to be served on the distiller specifying the defect or defects and requiring the same to be remedied.

    (2)   A distiller shall not, after the receipt of such a notice, distil spirits in such still, until he or she shall have remedied the defects specified, to the satisfaction of the Comptroller of Excise.

    (3)   The Comptroller of Excise may, after the service of such a notice, cause to be affixed to the still or any part thereof such fastenings or other appliances as may be necessary to prevent the distillation of spirits in such still.

    (4)   The Comptroller of Excise shall, at the request in writing of a distiller on whom such a notice has been served, report the matter to the Minister who may, if he or she thinks fit, rescind such notice; the Minister may take into consideration any representations which the distiller may make with respect to such notice.

    (5)   Any distiller who acts in contravention of subsection (2) shall incur a penalty not exceeding $1,000.
