77.   Discretion to exclude confessions

In criminal proceedings, where evidence of confession is adduced by the prosecution and, having regard to the circumstances in which the confession was made, it would be unfair to a defendant to use the evidence, the court may—

  1.  

    (a)     refuse to admit the evidence; or

  1.  

    (b)     refuse to admit the evidence to prove a particular fact.
