131.   Post and telecommunications

  1.  

    (1)   It shall be presumed, unless the contrary is proved, that a postal article sent by prepaid post addressed to a person at a specified address in Saint Lucia was received at that address in the ordinary course of post after the day on which it was posted.

    (2)   Where a message has been—

    1.  

      (a)     sent by means of a telecommunication service; or

    1.  

      (b)     delivered to an office of a telecommunications provider for transmission by the carrier and any fee payable in respect of that transmission has been paid,

    it shall be presumed, unless the contrary is proved, that the message was received by the person to whom it was addressed 24 hours after having been sent or delivered, respectively.

    (3)   Where a document that has been—

    1.  

      (a)     received from a telecommunications provider; or

    1.  

      (b)     produced by a telecommunications facility,

  1.  

    purports to contain a record of a message transmitted by means of a telecommunications service it shall be presumed, unless the contrary is proved, the message was so transmitted, and that it was sent by the person on whom or on whose behalf it purports to have been sent on the date on which and at the time at which, and from the place from which, it purports to have been sent.
